quervani.com is operated by Quervani, a sole proprietorship established in Gatineau, Québec, Canada.

2. Scope
These terms apply to every order placed on quervani.com.
Online sales to Quebec consumers are distance contracts under Quebec's Consumer Protection Act (CPA). That Act gives you rights we cannot contract out of, and nothing below reduces them. If any clause here conflicts with the CPA, the CPA prevails.
3. Products
We sell portable battery-powered cooling accessories.
Photos and descriptions are intended to represent the products faithfully. Slight colour variation may occur depending on your screen.
If the product you receive does not match the description published on this site, you may cancel your purchase — see section 9.
4. Pricing
All prices are in Canadian dollars. The price shown is the total payable for the product.
No GST or QST is charged. Quervani is a small supplier and is not registered for sales tax.
Shipping costs are shown separately and presented to you before you confirm your order. There are no hidden fees or processing charges.
We may change prices at any time, but the price that applies to your order is the one displayed when you confirm it.
5. Placing an order
You add the product to your cart, enter your contact and shipping details, and reach a review page that lets you check and correct any error before confirming. You then confirm and pay, and receive an order confirmation by email.
Under section 54.6 of the CPA, a written copy of the contract is sent to you by email within 15 days of the transaction — in practice, immediately after your purchase.
We reserve the right to refuse or cancel an order in case of stock-out, obvious error or suspected fraud. If we do, you are refunded in full.
6. Payment
Payment is made by credit card, processed through Shopify Payments.
Paying by credit card guarantees you a chargeback remedy with your card issuer if we fail to meet our obligations and do not refund you within the timeframes the law requires.
7. Delivery
We ship within Canada only. Our products are shipped from overseas — please allow 14 to 30 days from the date of your order. Full details are in our Shipping Policy.
The risk of loss or damage in transit is ours. If your parcel is lost or stolen before it reaches you, that is not your problem. Contact us and we will reship or refund.
Cancellation for late delivery. If you do not receive your product within 30 days of the stated delivery timeframe, you may cancel at any time before receiving it. We refund you in full within 15 days.
8. Legal warranties
Your products are covered, automatically and free of charge, by the legal warranties under the CPA.
The warranty of fitness for purpose (s. 37) means the product must be fit for the purpose for which it is ordinarily used.
The warranty of durability (s. 38) means the product must be usable for normal use for a reasonable length of time, having regard to its price, the contract and the conditions of use. This is not limited to the length of any manufacturer's warranty.
The warranty of quality and against latent defects under the Civil Code of Québec also applies.
These warranties apply in addition to any manufacturer's warranty, and we cannot waive or exclude them. If a product fails prematurely, write to us — depending on the case, we will repair it, replace it, or refund you.
Replacement parts and repair. Quervani does not guarantee the availability of replacement parts, repair services, or the information needed to maintain or repair its products.
9. Cancellation, returns and refunds
Our commercial return policy is set out in our Refund Policy.
Independently of that policy, the CPA lets you cancel your purchase where a mandatory disclosure was not made to you before the purchase; where we did not send you a copy of the contract; where the product received does not match the description on this site; or where you did not receive the product within 30 days of the agreed date.
In those cases, return shipping is at our expense and we refund you in full within 15 days of cancellation. If we don't, and you paid by credit card, you can request a chargeback from your financial institution.
10. Your remedies
For clarity, and in accordance with the CPA:
• We impose no arbitration clause. You keep your right to go to court.
• We do not prevent you from joining a class action.
• No clause in these terms can deprive you of a right the CPA gives you.
Any clause to the contrary is null and of no effect.
11. Limitation of liability
Subject to the legal warranties in section 8, which we do not derogate from, our liability is limited to the price paid for the product concerned.
We are not liable for damage arising from abnormal use, modification of the product, or failure to follow the usage and charging instructions supplied with it.
12. Intellectual property
The content of this site — text, images, logo, the Quervani name — belongs to us. Reproduction without written permission is prohibited.

14. Governing law
These terms are governed by the laws applicable in Quebec. Any dispute falls within the jurisdiction of the courts of the judicial district of Gatineau.
A consumer resident in another province keeps the rights granted by that province's consumer protection legislation.
15. Changes
We may amend these terms. The version that applies to your order is the one in force when you place it.
